Scroll down for a sample of this year's recent monthly successes. JANUARY 2010The law firm started this year off by settling one of the most complex cases that the firm has ever had. We successfully represented a woman who suffered a dissected carotid artery, an elongated styloid process, and who developed Glossopharyngyl Neuralgia (GPN) from a single vehicle incident in which she suddenly swerved to avoid a crash in front of her. Our client's vehicle did not strike any vehicle or object, and the vehicle that crashed was not identified. At the scene our client was shaken-up but did not report the incident to the police or seek medical attention. The client also had significant pre-existing injuries to her neck and shoulder for which she had had surgeries and had been previously disabled for five years. At the time of this incident our client was working full-time and able to engage in all her usual daily activities. Under our client's own auto insurance policy, we pursued an Uninsured Motorist (UM), Medical Payment, and Personal Injury Protection (PIP) claims, and ultimately recovered over $225,000 before the arbitration. FEBRUARYAs courts in Massachusetts continue to consider changing the laws regarding "snow & ice" and "failure to warn" cases, we negotiated a settlement case for a client who walked across a snowy field, and stepped over a snowbank and onto an icy sidewalk when she then slipped and fell. The insurance company argued that the ice was a "natural accumulation" and an "open and obvious" condition, which would likely have provided a defense to our claim. However, we were able to strategize a legal theory against the apartment complex in which we argued it still had an duty to remove the unsafe condition. Ultimately, our client received full compensation for her injuries and disability. MARCHThis month we successfully settled a hotly contest and litigated car accident case for a client who was previously represented by another lawyer. We agreed to represent him at no additional cost in legal fees. The case became a battle over which driver had the right of way, and whether our client suffered the injuries that he claimed. After we took the testimony of both the other driver and the investigating police officer, we were confident that we could establish that the defendant failed to yield the right of way and caused the car crash. Additionally, our client, a home remodeler, was sufferring from arm weakness and numbness for over 4 years when we had him examined by an expert in pain and rehabilitative medicine. Not only did the doctor, at our request and cost, write a great report for the case, he also implemented a medical treatment plan that cured our client. We were able to negotiate a fair settlement just prior to trial. APRILIn this case we obtained a settlement for a little girl who was the innocent victim of a dog bite attack to the face, neck, and back. The young child's bite marks and lacerations did not need stiches but left some scarring, which was fading over time. After we negotiated the payment, with the girl's mother, we presented the case to the court for approval of a Petition for a Minor's Settlement and the Judge agreed the settlement amount was in the best interests of the child and approved the Petition. |
