Boston Snow & Ice Slip-and-Falls Attorney

Handling Injuries That Result From a Slip-and-Fall on Snow or Ice

The winters in Boston can be brutal. Snow and ice can accumulate, leaving the sidewalks and roadways slick and dangerous. Until recently, if you slipped and fell on someone else's property due to snow or ice, there was no liability. However, now it is possible to seek compensation for a snow and ice slip-and-fall.

At The Law Firm of Scott D. Goldberg, P.C., in Boston, we can confidently handle new snow and ice slip-and-fall cases that are covered by the new liability laws. Our firm stays current on any changes in the law that may affect our clients' abilities to recover damages for pain and suffering, lost wages and medical expenses.

The highest court in Massachusetts was the one that changed this type of liability law. The law now does not distinguish the difference between a natural accumulation of snow and ice and an unnatural accumulation. Before, if the accumulation was deemed to be natural, and the property owner could not have been expected to keep it absolutely clear, then there is no liability. Property owners were protected from lawsuits when the accumulation was natural.

However, under the new laws, regardless of the type of accumulation, a lawsuit can be filed if the standard of reasonableness is not met. That is, if it is reasonable that a property owner could have, in fact, kept an unnatural accumulation of snow and ice clear and safe for the property's visitors, then there is liability.

This is an extremely new area of the law and the cases are still difficult to prove. However, to discuss the merits of your case, get in touch with attorney Scott Goldberg at our firm. He can review your case and determine how to proceed with the matter.
